By accessing or using the Puntafy website (“Website”) or engaging Puntafy for services (“Services”), you agree to be legally bound by these Terms.

If you do not agree, you must not use this Website or our Services.

2. Description of Services

Puntafy provides marketing strategy, digital marketing services, AI-powered automation solutions, consulting, and related services.

Puntafy may:

• Develop marketing materials

• Use artificial intelligence tools

• Provide strategic consulting

• Implement automation systems

• Deliver creative and technical outputs

All services are subject to separate written agreements where applicable.

3. No Guaranteed Results

Puntafy does not guarantee:

• Revenue increases

• Lead generation numbers

• Algorithm performance

• Platform visibility

• Advertising ROI

• Business growth outcomes

Marketing performance depends on factors outside Puntafy’s control including market conditions, client execution, platform changes, and economic factors.

All projections are estimates only.

4. Client Responsibilities

Clients agree to:

• Provide accurate information

• Comply with all laws

• Obtain rights to any content supplied

• Not use Puntafy services for unlawful purposes

The client is solely responsible for final business decisions and implementation of advice.

5. Artificial Intelligence Disclaimer

Puntafy may use AI tools to generate content, strategy, automation, or analysis.

Client acknowledges that:

• AI outputs may contain inaccuracies

• AI-generated content must be reviewed by the client

• Puntafy is not liable for decisions based solely on AI output

• AI tools are third-party technologies not controlled by Puntafy

6. Intellectual Property

Unless otherwise agreed in writing:

• Puntafy retains ownership of pre-existing materials and proprietary systems.

• Clients receive a non-exclusive license to use deliverables upon full payment.

• AI systems, frameworks, methodologies, prompts, and internal tools remain Puntafy intellectual property.

7. Payments & Fees

• Fees are outlined in individual agreements.

• Late payments may incur interest.

• Puntafy may suspend services for non-payment.

If payment is processed via third-party providers (Stripe, PayPal, etc.), Puntafy is not responsible for those providers’ actions.

8. Limitation of Liability

To the maximum extent permitted by law:

Puntafy’s total liability shall not exceed the total fees paid by the client in the previous 3 months.

Puntafy shall not be liable for:

• Indirect damages

• Loss of profit

• Loss of data

• Loss of opportunity

• Business interruption

• Third-party claims

9. Indemnification

Client agrees to indemnify and hold Puntafy harmless against any claims arising from:

• Client misuse of services

• Unlawful marketing practices

• Copyright violations in materials provided by client

• Regulatory non-compliance

10. Confidentiality

Both parties agree to keep confidential information private unless required by law.

11. Termination

Puntafy may terminate services if:

• Client breaches terms

• Payment defaults

• Illegal activity occurs

12. Governing Law

These Terms are governed by the laws of Australia.

For EU clients, mandatory consumer protections under applicable EU law remain unaffected.
